Terms and conditions of sale and delivery

1. Validity
The following terms and conditions apply to all deliveries, goods, and services from CK Produktion, hereinafter referred to as CK, unless otherwise agreed in writing.

2. Offers
Unless otherwise stated, offers are valid for three months and are always subject to prior sale. Prices are subject to calculation or typing errors.

3. Orders/order confirmations
Orders are only binding on CK Produktion after CK has given its acceptance in the form of a written order confirmation. All orders are delivered at the confirmed price, however, in the case of framework orders that may extend over more than 3 months, CK reserves the right to make changes due to changes in supplier prices, exchange rate fluctuations, and other circumstances beyond CK's control.

4. Shipping and delivery terms
All orders are delivered ex works and exclude special packaging, unless otherwise agreed in writing. The confirmed delivery date is always considered the date of dispatch from CK, unless otherwise agreed in writing.
All confirmed delivery times are given to the best of our knowledge. CK accepts no liability for any delays or consequences thereof, nor does this entitle the buyer to cancel the purchase without CK's consent.
Similarly, CK shall not be liable for any compensation in the event of incorrect labeling/incorrect deliveries, other than the redelivery of the goods to the original address. This includes payment for shipping on the same terms as the original shipment.

5. Terms of payment
As stated in the order confirmation and/or invoice. The buyer is not entitled to withhold payment due to any complaints or other counterclaims without this being accepted in writing by CK. In the event of late payment, the buyer will be charged interest at the rate set by CK at any given time.

6. Returns
Goods may never be returned without prior written agreement and will otherwise always be at the customer's full expense and risk.
CK will also refuse to accept unstamped return shipments without prior agreement.
Any agreed returns must be made in such a way as to avoid further damage during return.

7. Complaints
Any complaints must be reported to CK as soon as possible so that any errors can be rectified immediately. Complaints cannot be made about goods that are “collected over time” and returned mixed/loosely packed. CK will always handle any complaints quickly and seriously, reporting back to the customer on measures taken to prevent recurrence.
For complaints/replacement deliveries/credit notes to be accepted, the following conditions must be met:

• Any transport damage must be reported within 8 days, with a copy of the consignment note bearing a note and the carrier's signature.
• Deliveries with defects of less than 1% cannot be reported.
• The goods must not have been subjected to any form of assembly or processing.
• Complaints made more than 6 months after delivery are considered “outdated.”
• Goods that are agreed to be returned for inspection, sorting, or reprocessing must be returned by the customer in their original packaging.

CK's main effort and goal is: 
That no complaints are necessary.

8. Retention of title
Delivered goods remain the property of CK until full payment of interest and other costs has been made.
Tools, molds, and production equipment cannot be delivered, regardless of whether they have been paid for, if there are outstanding amounts for goods/services in general.

9. Product liability
CK is liable for damage to persons or property resulting from defects in delivered products only to the extent that liability can be imposed on CK. However, CK disclaims any liability for loss of time, loss of business, loss of profit, or similar indirect losses. CK shall also never be liable for defects resulting from poor design or assembly carried out by the buyer, or damage resulting from incorrect or careless use/application, possibly as a result of inadequate instructions for use prepared by the buyer.

10. Legal proceedings and disputes
Shall be settled in accordance with Danish law and with jurisdiction in the court district in Denmark where CK has its place of jurisdiction at any given time. The court in Grindsted.
